Form 2290: What Trucking Fleets Need to Know About HVUT

I f you operate heavy vehicles on public highways in the United States, Form 2290 is a crucial part of staying compliant with federal tax regulations. Also known as the Heavy Highway Vehicle Use Tax Return, this form is used to report and pay the Heavy Vehicle Use Tax (HVUT).

In this post, we’ll cover the who, what, when, and how of filing Form 2290 to help you avoid penalties and keep your business running smoothly.

What Is Form 2290?

Form 2290 is required by the Internal Revenue Service (IRS) for any vehicle that:

Has a gross weight of 55,000 pounds or more, and
Travels more than 5,000 miles per year (or 7,500 miles for agricultural vehicles).

The tax helps fund the maintenance and construction of the nation’s highway system.

Who Needs to File Form 2290?

Y ou must file Form 2290 if:

You own a taxable highway motor vehicle.
The vehicle is registered in your name under state, District of Columbia, or tribal motor vehicle registration laws.
The vehicle meets the weight and mileage criteria above.

This includes:

Owner-operators
Trucking companies
Leasing companies
Agricultural transporters (with special mileage exemptions)

When Is Form 2290 Due?

The annual tax period for Form 2290 runs from July 1 through June 30 of the following year. You must file by the end of the month following the month the vehicle is first used on public highways.

Examples:

If you first use the vehicle in July, you must file by August 31.
If you start using a vehicle in October, your due date is November 30.

How Much Is the HVUT?

The tax rate depends on the gross taxable weight of the vehicle and whether it is used for agricultural purposes.

Typical Range: $100 to $550 per vehicle per year.
The maximum tax applies to vehicles that are 80,000 pounds or more.

Vehicles that are not expected to exceed the mileage limit can be filed as suspended vehicles (category W), but still need to be reported.

How to File Form 2290

Electronically (e-file) – Required for filers with 25 or more vehicles.
Paper filing – Only allowed for those filing fewer than 25 vehicles.

Fleet Exemptions for Transportation Sales Tax

Transportation (in sales and use tax law) generally refers to companies who are in the business of transporting tangible personal property for others in interstate and/or intrastate commerce. This movement can be by the means of rolling stock trucks, truck tractors, trailers, etc. States most often require transportation companies to first be registered as an "Interstate Common Carriers" (ICC) as prescribed under federal law. Once this classification is obtained, a transportation company, may then claim very specific sales and use tax exemptions. These exemptions can include exemption from tax on the purchase of the transportation equipment, and can be extended by a state to the tangible personal property used to the repair the equipment.

In states that tax specific services, some have also granted sales and use tax exemptions to services (repair and maintenance labor) rendered on the actual transportation equipment. Approximately two-thirds of the states grant the above cost saving exemptions for the purchase or lease of transportation equipment (rolling stock). While only one-third of the states grant the above cost saving exemptions on repair parts to the equipment.

The transportation industry is an extremely complicated industry to understand when attempting sales and use taxes. Many transportation, specially trucking operations, do not have accounting personnel who study the business operations and exemptions. As a result, many trucking operations fail to advantage of these exemptions missing out on thousands of cost savings.

Exemptions are statutory, not loopholes, and are closely regulated but can save companies significant cost. To take advantage of these exemptions, a company needs to be a transportation company. Many questions arise when companies look to take advantage of these exemptions.

The Federal Income Tax: How It Measures Up and What It Costs

The Federal Income Tax – We’ve recently been working on our federal income taxes, since Tax Day is next Monday this year. Probably many of you have been too. From time to time, we’re called on to evaluate tax proposals of various kinds, and we’ve developed a number of criteria that help one to tell a bad tax from one that’s, well, not so bad. Most tax people, we’ve found, use a set similar to ours. It occurred to us to run the federal personal income tax past these criteria, so see how it comes out (although we had our suspicions before we began). Here goes: The first criterion, and actually one of the more important, is Efficiency; that is, a tax is Efficient if it can be administered and complied with relatively inexpensively. One source says compliance with the U.S. income taxes may cost $1 trillion annually. (See www.mercatus.org .) Efficient? Nope. Equitable? With a tax, fairness is largely in the eye of the beholder, but it can plausibly stand for the notion that similarly situated taxpayers – whatever that means – pay similar amounts of tax. But with a tax system so complex as to be almost arbitrary, who can judge this? The personal income tax is Effective, however. That is, it does bring in a lot of money. Is the personal income tax Enforceable? IRS says it is, as far as income that is both reported and withheld on, such as wages, is concerned. For income that is reported but not withheld on – payments requiring a Form 1099, let’s say – not so much. For income that is neither reported nor withheld on, hardly at all. Well then, is the tax Competitive – does it disadvantage U.S. individuals vis-à-vis other people? With a national tax, this is mostly a moot point, but we would point out that many American living abroad more or less permanently are mightily tempted to give up their citizenship rather than continue paying U.S. taxes – and many do. Is the personal income tax Neutral, or do tax considerations unduly affect personal and business decisions that we all make? Ha! Finally, is the personal income tax Nonintrusive? No, not that either, since IRS knows a great many personal details of all of us with income enough to tax (and is it’s evidently none too careful with those details, either). We could add up the score here, but we’ll let you draw your own conclusions. Oh yes – the corporate income tax? Let’s just say it comes out worse than the individual tax on every single criterion.

Update on NYS HUT Credentials – Speaking as we were of bad taxes, the New York State budget bill, signed April 12, 2016, includes a reduction in the fees the state charges for its highway use (weight-distance) tax credentials from $19 per vehicle for a permit and decal to $1.50. A recent court decision had held the higher fees to be a violation of the Commerce Clause, but suggested that a much lower fee might not be. The New York State Motor Truck Association reported yesterday that the state’s OSCAR system is once again available to carriers not based in New York, for the purchase of permits and decals. Tax Freedom Day Approaching – Every year the Tax Foundation declares Tax Freedom Day, the day the average American has paid off all his local, state, and federal taxes and can keep the rest of what he makes the remainder of the year. This year, that day is April 24. That’s a day earlier than last year, because, says the Tax Foundation, it estimates that the federal government will be collecting slightly less revenue this year overall. But the feds will still be collecting some $3.3 trillion in 2016, and state and local governments about half that much on top of it. Of course the tax burden varies by state; April 24 just represents the average. In Connecticut, people aren’t tax-free until May 21 this year, while in Mississippi they were all paid up nearly two weeks ago, on April 5. IRS Proposes Permanent Excise Tax Regs – The Federal Register of March 31, 2016, carried a Notice of Proposed Rulemaking from the federal Internal Revenue Service proposing permanent rules for the 12 percent excise tax on the sale of trucks, trailers, and parts and for the federal tax on heavy tires. The proposal also reworks the definition of “highway vehicle” for purposes of those two taxes and for the federal excises on fuel and for the heavy vehicle use tax. Since soon after the current set of highway user taxes was imposed by Congress in the early 1980s, IRS has administered these taxes under temporary regulations, most of which have now been in effect for more than 30 years. The proposal reorganizes and restates much of the existing regs, and incorporates a few legislative changes and court cases that have been enacted or decided in the interim, but there don’t appear to be any surprises here. If you see something new and unpleasant, please let us know! There is a 90-day period for public comments on the IRS proposal.

IFTA Members Approve Amendments – Voting by the states and provinces on this year’s proposals to amend the International Fuel Tax Agreement ended March 24. We understand that all seven of the proposed amendments were adopted by IFTA, a process that requires an affirmative vote by at least 75 percent of all 58 IFTA members. Only one of the proposals this year was critical – the one setting a standard for liquefied natural gas – but several of the others are of some interest. (The remaining proposals are administrative only.) The most important ballot proposal – No. 5 – sets 6.06 pounds or 0.73 kilograms (for IFTA filers based in Canada) as the standard unit (a diesel gallon equivalent) for purposes of IFTA reporting of LNG. The same standard that has been adopted by IRS and by more than half the states, with the remainder using a variety of units. Without a uniform unit of measure for a fuel, IFTA reporting of that fuel simply won’t work, and LNG cannot be measured directly in volumetric units. This change to IFTA is effective only July 1, 2017, but it is expected that the delay will affect few IFTA filers. The other ballots of interest are: No. 3, which requires the states and provinces to upload demographic data on their IFTA accounts to the IFTA Clearinghouse daily, to improve the timeliness of information; No. 6, which makes a failure of a state or province “to audit on behalf of all other IFTA jurisdictions” an infraction that may be taken to the IFTA Dispute Resolution Committee (although no one really knows what that requirement may mean in practice); and No. 7, which requires jurisdictions to include on the audit reports they give to carriers and to the other states and provinces the date through which interest has been calculated on any underpayments.

AZ Court Finds Tort Lawsuit to Be a Tax Appeal – The Arizona Court of Appeals has upheld the decision of a lower court to the effect that a taxpayer’s tort claims against a county and its officials amounted to a tax appeal. The plaintiff here, representing himself, claimed that the county and its assessing officials had acted with gross negligence and had negligently and intentionally inflicted emotional harm on him. The county argued, and the court agreed, that the plaintiff had failed to allege facts to support any of these tort claims. However, rather than dismiss the case, the court instead, acting under the state rules of civil procedure, converted it into a tax appeal, in order “to achieve substantial justice.” And it granted the plaintiff a measure of tax relief for the one year remaining open under the statute of limitations. It also, pursuant to state law on successful tax appeals, awarded him a portion of his court costs. Lockerby v. Pima Cty., et al., docket no. 1 CA-CV 15-0277, decided March 24, 2016
